General terms

Purpose

These terms govern the use of the kaperx.ma website, published by Kaper Group SARL. By browsing the website, you accept them. They also apply to KaperX services (websites, portals and digital tools); the specific conditions of each service are set out in its quote.

Access to the website

The website is free to access and requires no account. We do our best to keep it available at all times, but access may be interrupted for maintenance or updates, or in the event of a technical incident.

Nature of the content

Our guides are general information:

  • they do not constitute legal, tax or regulatory advice;
  • they reflect the state of the law at the date of their last update, shown on each page;
  • they do not take your particular circumstances into account.

Before making any decision that commits your organisation, particularly on compliance matters, have your situation reviewed by a qualified professional.

Permitted use

You may consult the content, share it by link and quote short extracts from it, provided that you state the source and link back to the original page.

You may not:

  • reproduce in full or republish the content without written consent;
  • use the website in a way that disrupts its operation (automated submissions, intrusion attempts, unauthorised large-scale data collection);
  • use the contact form to send advertising, unlawful messages or messages unrelated to our business.

Intellectual property

The content, the KaperX name and the KaperX logo are protected. Details are set out in our Legal Notice.

Liability

We cannot be held liable for decisions taken solely on the basis of information published on this website, for any damage resulting from the website being unavailable, or for the content of third-party websites to which we link.

Prices and right of withdrawal

Prices for the services presented on this website are shown including all taxes. Each service has a written scope and price, accepted before any work starts.

When you act as a consumer within the meaning of Law No. 31-08 on consumer protection measures and the contract is concluded at a distance, you have seven days to exercise your right of withdrawal, without having to give reasons or pay penalties. This right applies under the conditions and exceptions set by the law, in particular where performance of the service has begun, with your agreement, before the end of that period (Law 31-08, Articles 36 and 38). It is reserved for consumers: it does not cover contracts concluded for the purposes of a professional activity.

Quote and order

Each service is set out in a written quote: scope, price including all taxes, timeline and assumptions. The order is formed by your written acceptance of the quote. Any change of scope is set out in a written amendment, accepted before it is carried out.

Delivery and handover

Delivery includes go-live and a handover file: access, code, documentation and tested exports. Handover is accepted when the 10-point ownership standard is met.

Ownership

The domain, hosting, accounts, code and data are in your name, under our 10-point ownership standard. Third-party components (libraries, fonts, services) remain subject to their own licences, listed in the documentation.

Maintenance

Maintenance is covered by a separate contract, optional and terminable.

Exit plan

Every project is delivered with an exit plan: timeline, support during the transition and a cost stated in advance.

Personal data

See our Privacy Policy and our Cookie Policy.

Changes to these terms

We may amend these terms at any time. The applicable version is the one online at the time of your visit.

Governing law

These terms are governed by Moroccan law.
